The family of the man whose Aug. 28 death spurred the first recall of Toyota vehicles for unintended acceleration has filed a products liability and negligence lawsuit against the Japanese automaker.
Mark Saylor, 45, a California Highway Patrol Officer, was killed along with his family after the 2009 Lexus he was driving suddenly accelerated out of control while on Interstate 125 near San Diego.

The Lexus reached speeds of more than 100 miles per hour before striking another vehicle, breaking through a fence, striking a beam, flying through the air, rolling several times and then bursting into flames, the complaint says.
The crash prompted Toyota in September to begin recalling 4.2 million Toyota and Lexus models. At the time, the company blamed the problem on faulty floor mats. In January, the company recalled another 2.3 million vehicles, citing accelerator pedals that tended to get stuck in the depressed position.
The plaintiffs are Saylor’s parents, John Saylor and Joan Robbins; and the parents of his wife and brother-in-law, Fe and Cleto Lastrella.
The defendants in the Saylor suit are Toyota and several of its divisions plus the parent corporation of Bob Baker Lexus in El Cajon, Calif., the dealership that gave Saylor the vehicle while his 2006 Lexus was being repaired.
